There are a variety of Active Adult Communities in Lake County, each with a style or theme, which give the communities a unique identity. Housing styles are varied as well, with active adult manufactured homes to gated, single family home sites. Nearly all active adult communities offer a pool and clubhouse, and some larger neighborhoods have golf courses, multiple pools, outdoor sport courts, fitness and wellness centers, and multi-purpose buildings with classes, recreational activities, and social functions. Many existing active adult communities allow golf carts to travel within the neighborhood and are adding pickleball courts for the fastest growing sport in the United States!

What designates an Active Adult Community?

The Housing For Older Persons Act allows age-restricted housing by carving out an exemption to the federal fair housing law prohibition against discrimination on the basis of familial status. For all levels of age restriction, it is important to note that the requirements apply to the occupants, not the owners.

Federal law sets forth two levels of age-restricted housing:

• 55+ Housing where 80% of units must be occupied by at least one person age 55 or older per unit. A maximum of 20% of units may be occupied by residents under age 55.

• 62+ Housing states that residents must be at least age 62. The facility must publish, and adhere to, policies and procedures that demonstrate the intent to provide housing for older persons. Residents’ ages must be verified through reliable surveys or affidavits.

No programs of planned activities are required for either 55+ or 62+ housing. In researching a particular 55+ community, we will assist you in verifying if the community has reached its maximum 20% occupancy.
